Rules of the Game

Effective date: July 6th, 2023

Welcome to Gamefun

General

No purchase or payment for any item is required to win at Gamefun. No payment or purchase increases a Participant's chances of winning. By participating in the Game, all Users agree to abide by and be bound by these official Game rules and consent to the use of their personal information to operate the Game.

Participants

The Game is open to all registered users of Gamefun, legal residents of all countries where the Gamefun App is distributed in the Google Play Store and AppStore, who are at least 18 years of age or of legal majority (whichever is higher) at the time of participation in the Game ("Participants"). Participants are not eligible to participate in the Games if they are:

  1. an employee, officer, director, representative or agent of Unioncost L.L.C-FZ. (the "raffle Sponsor"), its parent, subsidiaries, related or affiliated companies or, if applicable, any of their respective advertising or promotion agencies, or any other company or individual engaged in the provision of goods or services related to this raffle (collectively, the "raffle Parties")
  2. a member of the immediate family (parent, child, sibling, spouse, grandparent, grandchild, cousin, aunt or uncle, whether related through blood, marriage, common law, civil union or adoption, regardless of where they live) or household (whether related or not), of any of the above individuals, directly or indirectly related.

Period of the Game

The Game is announced in the Gamefun app and/or on the Gamefun website in the form of a countdown that shows the time until the next Game. Gamefun may, at its discretion, announce a new Game or cancel an upcoming Game at any time and without any reason.

Participation

To participate, the user must:

  1. Follow the instructions on the GameFun app or website, Participants need to accept and agree to the Privacy Policy, Terms and conditions and these Game Rules, and be at least 18 years old.

  2. Use the Gamefun app or website to accumulate Diamonds. Diamonds can be obtained in a variety of ways, including:

    • playing games
    • using the Spin section
    • other specific in-game actions.

  3. Diamonds have no real value. In the event of a dispute as to the identity of a participant, each entry will be deemed to have been submitted by the registered owner (as defined below) of the account ID associated with that entry. The "Registered Owner" is defined as an individual who is assigned an identifier upon registration.

Winning the Game

  1. Selected participants are notified after completing the Game via an announcement and/or an in-app notification
  2. At the end of each period, the results of the Game are determined.

Games

  1. To participate in the Games, Users exchange Diamonds for Opportunities, which are 1-9 digit numbers.
  2. At the end of the Game, Participants have 1 week to check the results. After one week the Participant will not be able to check the results.
  3. The Organizer reserves the right to change the rules of the Game and cancel the Game at any time for any reason, especially in case of suspected cheating and violation of the rules of the Game.

Right to Suspend, Modify and Terminate the Game

The Game Sponsor reserves the right, in its sole discretion, to suspend or cancel the Game at any time if for any reason the Game cannot be conducted as planned, including, without limitation, computer virus infection, bugs, tampering, unauthorized interference, fraud, technical failures or any other cause that damages or affects the administration, security, fairness, integrity or proper conduct of the Game ("Interruption"). The Game Organizer reserves the right, in its sole discretion, to cancel, suspend and/or modify the Game or any portion thereof and to disqualify any person who is responsible for any Interruption, interferes with the entry process, the operation of the Application or otherwise violates these Official Rules. In the event of termination of the Game, the Organizer may, in its sole discretion, determine the results of the Game.

Confidentiality, Publicity and Intellectual Property Rights

For purposes of these Official Rules, Intellectual Property Rights shall mean any trademarks, copyrights, moral rights, performer's rights, confidential information, trade secrets and all or any other intellectual or industrial property rights, whether registered or unregistered anywhere in the world, including any extensions and extensions and including any such rights discovered or invented after the date hereof.

Each Participant agrees to keep confidential any information that the Participant knows or reasonably should know to be confidential and relating to Gamefun and Gamefun's business.

Each Participant agrees to participate, at Gamefun's request, in advertising (including interviews) and further agrees that Gamefun owns all intellectual property rights to such advertising/interviews and may use them at Gamefun's absolute discretion. Gamefun may refer to the Participant's association with the Game in all advertising, marketing and other materials.

The Participant shall not publicize his participation in the Game (including interviews) except with Gamefun's prior written consent.

By participating in the Game or submitting a video, image, audio file or any other material in connection with the Game and its consequences, each Participant:

  1. Acknowledges that the Participant grants Gamefun a worldwide, perpetual, royalty-free license to the intellectual property rights of the Products or Gamefun entry.
  2. Waives any moral rights and rights of type that the Participant has with respect to the Products or Gamefun entry, so that Gamefun shall be entitled to use the Products or Gamefun entry in any and all media at no cost to Gamefun.
  3. warrants to Gamefun that the Products or Gamefun entry:
    • are personal and related specifically to the Participant
    • are owned and controlled by the Participant and that the Participant has the right, power and authority to grant the rights set out in these terms and conditions
    • will not infringe the Intellectual Property Rights, privacy or any other rights of any third party
    • will not contain anything which is untrue, defamatory, obscene, indecent, harassing or threatening
    • do not violate any applicable law or regulation (including any laws regarding anti-discrimination or false advertising)
    • are not obscene or pornographic
    • do not, to the best of the Participant's knowledge, contain any viruses or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information
    • are free from any encumbrances such that Gamefun may use the Products in accordance with and in the manner set out in these Official raffle Rules.

For the avoidance of doubt, all rights will be held solely by Gamefun for its own use (at its absolute discretion).

Limitation of Liability and Release of Liability

Participants assume no responsibility for interruptions, technical problems or technical failures arising from any of the following phenomena that may affect the Game: hardware or software bugs; computer, cable, satellite, network, electronics, Internet connection or other online or network communication problems; errors or limitations of any Internet service providers, servers, hosts or other providers; indiscriminate, confusing or erroneous transmissions; failure to send or receive any online transmissions; lost, late, delayed or intercepted transmissions; unavailability of the Application in whole or in part for any reason; congestion on the Internet or the Application's servers; unauthorized human or non-human interference with the operation of the Application, including, without limitation, unauthorized tampering, hacking, theft, virus, bugs or worms; or destruction of any aspect of the Game; or loss, misregistration, misdirection, inaccessibility or unavailability of an email account used in connection with the Game. The Parties are not responsible for any printing, typographical, technical, computer, network or human error that may occur in the conduct of the Game, the processing of Diamonds or applications, or in any materials related to the Game. Use of the Application is at the user's own risk. The Parties shall not be liable for injury, property damage or loss of any kind that may be caused to the computer equipment of the user or any other person as a result of using the Application. By using the Application, the participants agree to:

  1. Release, indemnify, and hold harmless the Application Parties, Facebook, Inc, Apple, Inc, and Google Inc from any claims, damages, or liabilities arising out of such member's use of the Application.
  2. All claims arising out of or related to this Application shall be resolved individually, without resort to any form of class action.
  3. All claims, judgments and awards shall be limited to actual costs incurred out of personal funds, excluding legal fees and court costs.

By using the App, the User agrees that the Game Organizer, its parent, subsidiary, related or affiliated companies or, if applicable, any of their respective advertising or promotional agencies, or any other company or individual engaged in providing goods or services related to this App, and their officers, directors, employees, representatives and agents shall have no liability and will be held harmless by the User from any liability for injury, loss or damage of any kind to persons or property arising in whole or in part, directly or indirectly, from the use of the Application.

ANY attempt by ANY INDIVIDUAL PERSON, whether or not a User, to WILLfully damage, destroy, deface or vandalize the APP of the Application or interfere with the operation of the Application is a violation of criminal and civil laws, and the Game Organizer reserves the right to seek damages and to pursue in good faith all remedies against any such person to the fullest extent permitted by law.

Privacy and public disclosure of information

The Game Organizer and its authorized agents will collect, use and disclose personal information provided when registering for the Application for the purposes of administering the Application and communicating with the User (if applicable) in accordance with the Game Organizer's Privacy Statement. Users consent to the publication and use of their name, statements, profile pictures, photographs, image and/or likeness in any form, manner or media now known or hereafter devised, including, without limitation, in print, radio, television, on the Application and on the Internet for any purpose related to the Application, including, without limitation, for purposes of advertising and trade and promotion of the Application, without further notice or compensation.

General Terms and Conditions

The Game Organizer is not responsible for any other expenses of the Users. Users are solely responsible for reporting and paying all taxes, if any, that may arise from the use of the Application. The Game Organizer reserves the right at any time to cancel or modify the Game and to modify or amend these Official Rules without notice, in its sole discretion, in accordance with applicable law.

This promotion is in no way sponsored, endorsed or administered by or associated with Facebook, Google or Apple.
